HR Investment and Consulting is a Romanian consultancy company providing Technical Assistance and PR services to companies, public organizations and institutions at local, regional, central and international level for implementing and carrying out projects funded by international donors.

Terms of Use

These Terms of Use hereby set out the terms and conditions laid down by HR INVESTMENT AND CONSULTING SRL (hereinafter referred to as HR) in relation to use of this website. If you do not fully agree to the conditions laid down herein, please cease using the services provided through www.hr-consultancy.ro.

1. Definitions

For the purposes of these terms and conditions, the following terms shall mean:

  • User - any person interested in receiving the service; 
  • Service - the user's access to data and information transmitted by HR  via the Internet, through www.hr-consultancy.ro;

2. User Obligations

2.1 The User agrees to use the service only for legal purposes. The User shall not:
a) alter, distribute, convey, display, copy, grant licences, develop any derivative works, transfer or sell any information collected or service provided via this website;
b) use directly or allow/authorise any third party to access HR services for transmitting or receiving materials that infringe the relevant laws in force or have obscene, abusive, vulgar, disparaging, offensive or menacing content, that infringe any intellectual property rights or violate the privacy of other persons, promote racial or ethnical segregation or are otherwise offensive; 
c) perform or allow cracking or hacking operations, or attempt "Denial of Service" attacks. Civil or criminal action shall be filed against users that breach system or network security.

2.2 The User agrees that in no event shall hold HR responsible or file any action against it in relation to any claim raised by any third party and related to the services provided by HR, as well as in relation to any other loss (be it direct, indirect, consequential or of other nature), cost, actions, legal proceedings, claims, charges (legal charges included) or other liabilities resulting from any direct or indirect action of HR, or from User breach or non-observance of these terms and conditions.

2.3 Any additional costs related to the use of the relevant services, including those levied by the telephony or Internet provider shall be charged to the Users.

3. Limitation of Liability

3.1 The User admits to fully understand and agree to the following:

I. Users are solely liable for the way the service is used. The service is provided according to the principle of the "current state" or "availability". In no event shall HR be held liable for any direct or indirect loss suffered by the User, resulting from or related to the use of the service, the service performance, of this website or of other linked websites.

II. HR shall not warrant that:

  • the service shall meet all your requirements;
  • the service shall be provided round the clock, in due time, safely and faultlessly;
  • all programming faults shall be remedied;
  • the service or the server which makes it available to users contains no viruses or components that may inflict on its users and cannot be blamed for any action you may take, based on the respective information or on the service.

III. Any material downloaded or otherwise obtained by using the service provided by HR are made available to the User and may be used by the latter at his own risk. The user is liable for any potential damage to the computer used for accessing the service or for any other data loss, generated by having downloaded the respective materials.

IV. No advice or information, in verbal or written form, obtained by the user via the service provided by HR shall not entail warranties that are not expressly set out in these Terms of Use.

3.2  HR liability (if  acknowledged by a Court of Law or an Arbitration Court) resulting from or related to provision of service as provided for in these Terms of Use is limited to USD 100 for any event or series of events.

4. Security

4.1 The User acknowledges that HR cannot control and warrant security of the information transmitted via its telecommunications network, the Internet and the Service.

4.2 The User acknowledges that the services are provided via the Internet and although HR is diligent in providing information security, it cannot warrant that the information received or transmitted by the User via the Service shall be always safe.

5. Connection to Other Networks

5.1 The User can use the service for the purpose of accessing various data posted by HR or for the purpose of connecting to other international or websites. The User agrees to observe User Policies applicable to the respective websites. The User acknowledges that HR has no control over the respective websites, cannot be held liable and is in no way bound with respect to other linked websites, to the links or the information contained therein.

5.2 Any link directing the User to other websites are meant to assist the User. HR denies support of the material posted on or made available through the respective websites or networks and any association with their operators. The User accesses such websites and uses their products and services at their own risk.

5.3 HR shall give no warranty on nationwide acceptable and available services and materials provided by third parties. If the User accesses the content or services of third party websites, HR denies any liability arising from the infringement of the local laws and regulations in force in the respective countries.

6. Intellectual Property Rights

6.1 Users expressly agree that all stylised representations, logos and symbols used solely or in combination with words or graphic symbols used on this site, are trademarks of HR.

7. Personal Data

7.1 By accessing this website, you agree that HR has the right to process your personal data, disclosed as a result of using the service, in compliance with the "Privacy Policy". This Policy is an integral part of these Terms of Use.

8. General Provisions

8.1 Alterations - HR may alter these terms from time to time, without notifying the Users. Users shall be notified in this respect by posting such changes on www.hr-consultancy.ro, which shall be deemed to have been agreed to by the User, if the latter continues to use the Service after the web posting of the respective changes.

8.2 Force Majeure - HR shall not be in any way liable for any failure to perform its obligations as provided hereunder, as a result of any events beyond its reasonable control, including but not limited to Acts of God, inclement weather, act or omission of  the Government, or other relevant networks or authorities whose activity is beyond the control of HR.

8.3 Jurisdiction - This website (with the exception of the linked websites controlled by third parties) is controlled by HR. By accessing this site, the User agrees that this Agreement and any dispute arising in relation thereto shall be construed according to the Romanian law. The User agrees to submit to the exclusive jurisdiction of the courts in Romania and abroad. HR gives no assurance that the content of this website complies with the laws (intellectual property rights included) of countries other than Romania. If the User accesses this site from abroad, he is solely responsible of observing the local laws.

8.4 Confidentiality - HR gives no assurance on User confidentially accessing this site. HR shall not be liable for any damage suffered by the User or any other person, resulting from non-confidential accessing of this website. Any information disclosed by the User may be unsafely transmitted via the Internet. Third parties may be able to read the information transmitted by the User via this website. Certain services accessed by the User on this site allow HR to receive User private data.
